TERMS OF USE

Welcome to Manabies! We built Manabies to help children learn math through fun and meaningful gameplay. Whether you’re a teacher using Manabies in your classroom or a parent supporting learning at home, our goal is to make everything as simple, safe, and transparent as possible.

A few important things to know:

Manabies is free for schools.
Student data is never used for advertising. Ever.
There is no chat or open messaging – students cannot share personal information.
Schools stay in control of student data.
Parents stay in control at home.

We want teachers, students, and families to feel confident using Manabies. Thank you for being part of our mission to make learning joyful and accessible to every child.

These Terms of Use (“Terms”) govern your use of Manabies, an educational game provided by:

Manabies can be used in classrooms (“School Mode”) or at home (“Home Mode”). Your rights and responsibilities differ depending on how you use the Service.

1. Using Manabies

1.1 School Mode (classroom use)

Teachers and Schools may create and manage student accounts for use during classes.

For Schools located in the EU/EEA/UK the School determines the educational purposes of student data (equivalent to a “Data Controller” under GDPR) and Veska Games acts as a Data Processor under GDPR.

For Schools located in the United States Veska Games acts as a “School Official” under FERPA, functioning under the direct control of the School.

In the United States, Schools may authorize student use under COPPA’s school exception, and teachers do NOT need to collect parental signatures when the Service is used strictly for classroom purposes.

Student data is processed only for educational purposes and never for advertising or marketing. Manabies is free for school use. Manabies does not sell student data, does not use student data for behavioral advertising, and does not share student information with third parties except as necessary to operate the Service under School direction.

1.2 Home Mode (parent-managed use)

Parents may create and manage accounts for their children. Veska Games is the Data Controller. Parental consent is collected during sign-up where required by applicable law (for example, COPPA in the United States and GDPR-based child-consent rules in the EU/EEA/UK).

The game is free to play. Optional premium features may require a payment or subscription.

1.3 Children

Children may use Manabies:

in school under a teacher-created account, or
at home under a parent-created account with parental consent.

Children cannot create accounts themselves.

2. Accounts

Teacher accounts require:

Full name
Email

Student accounts require:

First name, first name + initial, or a school-assigned pseudonym
Class / grade
School affiliation

Parent accounts require:

Full name
Email

Payment information (if any) is processed by external payment processors. We do not store card details. All payment processing is handled by PCI-compliant third-party providers.

3. Data Roles (Summary)

Manabies operates in two distinct legal modes:

A) School Mode

School = Data Controller
Veska Games = Data Processor / School Official

We process student data solely on behalf of the School and only for educational purposes.

Schools may request a School Data Privacy Agreement (SDPA), a Data Processing Agreement (DPA), or a state-standardized student data privacy addendum (including CA, CO, IL, NY, TX). Veska Games will reasonably cooperate.

B) Home Mode

Veska Games = Data Controller. We determine how home-use data is processed (e.g., adaptive learning, progress reports). All data processing follows our Privacy Policy.

4. License

We grant you a limited, non-exclusive, revocable license to use Manabies for educational and personal (non-commercial) purposes in accordance with these Terms.

5. Acceptable Use

You agree not to:

misuse or disrupt the Service,
attempt unauthorized access,
harm or exploit children,
violate intellectual property rights,
interfere with the operation, security, or integrity of the Service,
reverse-engineer, decompile, disassemble, copy, modify, or create derivative works based on Manabies.

Manabies does not include chat features or open text fields for children to submit personal information.

6. Privacy

Your use of Manabies is also governed by our Privacy Policy, which explains:

what data we collect,
how we use it,
School Mode vs. Home Mode roles,
international transfers,
retention,
user rights.

By using Manabies, you agree to the Privacy Policy.

7. Payments (Optional)

Manabies is free to play. Parents may optionally purchase a subscription to unlock premium features. Schools are not charged. Payments are processed by third parties; we do not store card details.

8. Service Changes

We may modify, improve, or discontinue parts of the Service. Significant changes will be announced in advance.

9. De-Identified & Aggregated Data

We may use aggregated or de-identified data that cannot reasonably be used to identify any child, teacher, or school. Once personal identifiers are removed and the data can no longer reasonably be linked to an individual, it is no longer personal data under GDPR or COPPA.

We may use such data for:

product improvement,
analytics and statistics,
research,
marketing claims (e.g., “students solve 16 problems in 5 minutes”).

We never identify individuals or Schools without explicit permission.

10. Disclaimers

The Service is provided “AS IS” without warranties of any kind. Manabies is not an assessment tool; School Mode results support teaching but are not official grades unless a School decides otherwise. We do not guarantee uninterrupted or error-free operation.

Although we use industry-standard safeguards, no system is completely secure. We cannot guarantee absolute security of data transmitted or stored.

11. Liability

Except where prohibited by law, liability is limited to EUR 100 / USD 100 or the amount paid in the previous 12 months, whichever is higher.

For U.S. Schools: limitations apply only where permitted by state law. If state law prohibits limitation of liability for public schools, that law prevails.

We are not liable for indirect, incidental, or consequential damages.

12. Governing Law

A) U.S. Schools
Laws of the state where the School is located.

B) EU Schools
Laws of the Czech Republic.

C) Home Mode
Laws of the Czech Republic unless mandatory consumer protection laws apply in the parent’s country.

13. Dispute Resolution

A) Schools
U.S. Schools: state/federal courts in the School’s state.
EU Schools: courts of the Czech Republic.

B) Parents
Disputes resolved via binding individual arbitration unless prohibited by local consumer laws. Class actions are waived to the fullest extent permitted.

15. Apple App Store Terms

This Section applies to the Manabies mobile application when downloaded, accessed, or used through the Apple App Store.

15.1 Acknowledgement

These Terms are concluded between you and Veska Games s.r.o., not with Apple Inc. (“Apple”). Veska Games s.r.o., and not Apple, is solely responsible for Manabies and its content. These Terms do not provide usage rules for Manabies that conflict with the Apple Media Services Terms and Conditions.

15.2 Scope of License

Subject to your compliance with these Terms, Veska Games s.r.o. grants you a limited, non-exclusive, non-transferable license to use Manabies on any Apple-branded product that you own or control, and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions. Manabies may also be accessed and used by other accounts associated with the purchaser through Family Sharing or volume purchasing, where applicable.

15.3 Maintenance and Support

Veska Games s.r.o. is solely responsible for providing any maintenance and support services for Manabies, as required under applicable law or as described in these Terms. Apple has no obligation to provide any maintenance or support services for Manabies.

15.4 Warranty

To the maximum extent permitted by applicable law, Manabies is provided “AS IS” and without warranties of any kind, except for any warranties that cannot be excluded under applicable law. If Manabies fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, for Manabies to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation with respect to Manabies. Any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are the responsibility of Veska Games s.r.o., to the extent required by applicable law.

15.5 Product Claims

Veska Games s.r.o., not Apple, is responsible for addressing any claims by you or any third party relating to Manabies or your possession or use of Manabies, including: product liability claims; claims that Manabies fails to conform to any applicable legal or regulatory requirement; and claims arising under consumer protection, privacy, or similar legislation.

15.6 Intellectual Property Claims

If a third party claims that Manabies or your possession and use of Manabies infringes that third party’s intellectual property rights, Veska Games s.r.o., not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of that intellectual property infringement claim.

15.7 Legal Compliance

You represent and warrant that: (a) you are not located in a country or region that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.

15.9 Third-Party Terms

You agree to comply with all applicable third-party terms of agreement when using Manabies, including any applicable Apple Media Services Terms and Conditions and any terms that apply to your device, internet connection, wireless data service, or payment method.

15.10 Third-Party Beneficiary

You and Veska Games s.r.o. acknowledge and agree that Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms.

After you accept these Terms, Apple will have the right to enforce these Terms against you as a third-party beneficiary.
